Terms of Service

These Terms of Service (“Terms”) govern your access to and use of theZio (“theZio”, “we”, “us”), available at thezio.co and operated byPunyakriya Industries Private Limited, a company registered in India. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use theZio.

1. What theZio does

theZio lets Instagram creators set up automatic replies to comments and direct messages on their own posts. A creator connects their own Instagram account, defines keywords, and theZio sends an automatic reply or message on their behalf when someone comments with a matching keyword. theZio also delivers digital products a creator uploads, and gives creators a public page (thezio.co/<handle>) to list their links and products, where their audience can get free products or buy paid ones.

theZio is available on the website (thezio.co) and as an Android app. These Terms apply to both. Paid plans are bought on the website only.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract.
You must connect an Instagram account that you own or are authorised to manage.
You are responsible for activity under your account and for keeping your access secure.

3. Your responsibilities

You will comply with the Meta Platform Terms and the Instagram Terms of Use.
You will not use theZio to send spam, unsolicited bulk messages, or messages to people who have not interacted with your content. Automations are keyword-triggered by a person’s own comment or message - not cold outreach.
You will only message audience members within the windows and rules permitted by Instagram, and you will honour opt-out requests.
You are responsible for the content you configure (reply text, products, links) and for any product or service you sell through theZio.

4. Plans, billing, and refunds

Our Cancellation and Refund Policy has the full details, including when we refund a plan payment.

Paid plans are billed in advance on a recurring basis through our payment processor, Razorpay. Prices and plan limits are shown on our pricing page.
You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then.
If you delete your account, any paid subscription is cancelled at the same moment, so you are not charged again. Paid time left in the current billing period ends with the account and is not refunded.
Except as set out in our Cancellation and Refund Policy or where required by law, fees already paid are non-refundable. We may change prices with reasonable notice, effective from your next billing period.

4A. Selling and buying on creator pages

A creator who sells paid products on their page is the seller of those products and also agrees to our Seller Terms. theZio provides the page, the checkout and delivery, collects the payment for the creator as a marketplace through Razorpay, and pays the creator weekly after its fee. theZio is not the seller.
If you buy from a creator’s page, delivery is described in our Shipping and Delivery Policy and refunds in our Cancellation and Refund Policy. Payments are processed by Razorpay under its own terms.
A purchase gives you a personal licence to use the product. Do not share, resell or publish it unless the creator says you may.

5. Acceptable use

You may not use theZio to break the law, infringe others’ rights, distribute malware, harass anyone, or circumvent the rate limits and policies of Instagram or Meta. We may suspend or terminate accounts that do.

6. Intellectual property

theZio and its software, branding, and content are owned by us. You retain ownership of the content and data you provide. You grant us the limited rights needed to operate the service for you (for example, to store your settings and send messages on your behalf).

7. Third-party services

theZio relies on third parties including Instagram and the Meta Platform, Razorpay, and our hosting and infrastructure providers. Your use of those services is subject to their own terms, and we are not responsible for their availability or actions.

8. Disclaimers

theZio is provided “as is” without warranties of any kind. We do not guarantee that automations will run without interruption, that messages will always be delivered, or that the service will meet every requirement. Platform changes by Instagram or Meta can affect functionality outside our control.

9. Limitation of liability

To the maximum extent permitted by law, theZio will not be liable for indirect, incidental, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.

10. Termination

You may stop using theZio at any time. You can delete your account and its data yourself from Settings → Delete account, on the website or in the Android app; deletion is immediate and cannot be undone (see our Data Deletion page for every option). We may suspend or terminate access if you breach these Terms or use the service in a way that risks harm to others or to the platforms we integrate with.

11. Changes to these Terms

We may update these Terms from time to time. We will update the date at the top of this page, and material changes take effect once posted here. Continued use after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of India, and the courts of Mumbai, Maharashtra have exclusive jurisdiction over any dispute, subject to applicable law.
